Terms of Service for FashionVue

These Terms and Conditions are entered into by and between Andries Kloppers trading as FashionVue ("FashionVue", "we", "our", or "us") and you ("the user").
1. Agreement to Terms
By accessing and using the FashionVue mobile application ("App", "Service") or Website, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.
2. Description of Service
- AI-powered fashion recommendations and styling advice
- Personal style analysis and wardrobe management
- Fashion trend discovery and shopping assistance
- Community and sharing features
- Style visualization and virtual try-on capabilities
3. User Accounts
- Provide accurate information during registration
- Maintain confidentiality of credentials
- You must be at least 13 years old
- You are responsible for all activity under your account
4. Acceptable Use
You agree not to misuse the Service, interfere with other users, reverse engineer, exploit, or use the Service in violation of any law.
5. AI and Data Processing
Our AI analyzes your content (e.g., uploaded photos) to generate fashion suggestions and virtual try-ons. Results are algorithmic suggestions for entertainment/information and may not always be accurate.
6. Your Content and Our License to Use It
You retain all ownership rights to the content you upload to FashionVue, including your photos and clothing images ("Your Content").
However, to provide and improve our Service, you grant FashionVue a non-exclusive, royalty-free, worldwide, transferable license to use, host, store, reproduce, modify, create derivative works (such as your virtual try-ons), and display Your Content.
The purpose of this license is strictly limited to operating, developing, providing, and improving the FashionVue Service. This includes using anonymized and aggregated data from Your Content to train our artificial intelligence models to improve the accuracy of our virtual fits, style analysis, and recommendations for all users. We will never share your personally identifiable Content with other users or third-party marketers without your explicit consent.
7. Third-Party Services and Affiliate Links
FashionVue may contain links to third-party websites or services, such as online retailers, that are not owned or controlled by us.
Affiliate Disclosure: Some of these links may be affiliate links. This means that if you click on the link and make a purchase from the third-party site, we may earn a commission at no additional cost to you. This commission helps us to maintain and improve the FashionVue service.
We are not responsible for the content, privacy policies, or practices of any third-party websites or services. We encourage you to be aware when you leave our Service and to read the terms and privacy policies of any other site you visit.
8. Subscriptions and Credits
Some features require subscriptions or credits. Pricing, credit consumption, and allowances are described in-app. Purchases are processed by third-party providers. All sales are subject to their terms.
9. Subscriptions, Credits, and Refunds
Our Service may require the purchase of prepaid credits or a recurring subscription to access certain features ("Paid Services"). The terms of your purchase and your refund rights depend on the platform through which you made the purchase (e.g., our website via Paddle or the Apple App Store).
9.1. Platform-Specific Refund Policies
9.1.1. Purchases Made via our Website (Processed by Paddle)
For all purchases made on the FashionVue website, our third-party payment processor, Paddle, acts as the Merchant of Record.
Right of Withdrawal: You have the right to a full refund for any purchase of a credit pack or an initial subscription fee within 14 days of the purchase date, provided that you have not used any of the credits or subscription-based features from that purchase.
Requesting a Refund: To request a refund under this policy, please contact Paddle's support team directly or reach out to us at support@fashionvue.app with your purchase details.
Exception for Used Credits: When you use a credit, you are requesting the immediate performance of the service. By doing so, you acknowledge that you lose your 14-day right of withdrawal for the portion of the service you have consumed. Any credits that have been used to successfully generate content are non-refundable.
9.1.2. Purchases Made via the Apple App Store (In-App Purchases)
All purchases made through the FashionVue iOS app are processed by Apple Inc. via their App Store In-App Purchase system and are subject to Apple's Media Services Terms and Conditions.
Refund Process: FashionVue does not have the ability to process billing or issue refunds directly for these purchases. To request a refund, you must contact Apple Support directly through your App Store purchase history. Apple is the sole arbiter of all refund requests for In-App Purchases.
Policy on Consumed Services: By making an In-App Purchase, you agree to our policy that credits are for the immediate provision of a digital service. Once a credit is used to successfully generate content, the service is considered delivered and consumed. While you may request a refund from Apple for any reason, our policy is that used credits are non-refundable.
9.2. Failed Generations and Technical Issues
This policy applies to all purchases, regardless of the platform. If a service that consumes a credit fails to generate a result due to a technical fault on our end, the credit used for that attempt will be automatically refunded to your in-app account balance. If you notice a credit was consumed for a failed generation and not automatically returned, please contact our support team at support@fashionvue.app.
We reserve the right to investigate patterns of failed generations to prevent misuse of the system. Malicious or fraudulent attempts to trigger failures may result in account suspension.
9.3. Satisfaction with AI-Generated Results
This policy applies to all purchases, regardless of the platform. FashionVue uses advanced AI to generate results. By using our Paid Services, you acknowledge and accept the inherent variability and subjective nature of AI-generated content. Dissatisfaction with the artistic or stylistic outcome of a successfully generated result does not qualify for a refund of the credit used.

10. Termination
We may suspend or terminate access for violations of these Terms or to protect the Service and users.
11. Disclaimers
The Service is provided "as is" without warranties of any kind. We do not guarantee accuracy, availability, or fitness for a particular purpose.
12. Limitation of Liability
To the fullest extent permitted by law, FashionVue shall not be liable for indirect, incidental, special, consequential, or exemplary damages.

14. Updates and Continued Use
We may update these Terms from time to time. By continuing to access or use the App after updated Terms are published, you are deemed to have accepted the updates.
